State aid

MJH’s State Aid Practice is comprised of experts with many years’ experience in regulatory and transactional advisory services, who have for years been supporting businesses, financial institutions and public sector entities on matters relating to the granting and use of state aid. We have an in-depth understanding of both the workings of the national support system and the practices of EU authorities. Our aim is to ensure that our clients derive maximum benefit from the available instruments whilst minimising legal and financial risks.

We advise on investment aid, regional aid, sector-specific aid and de minimis aid, as well as under EU and national programmes. We regularly assist clients in the energy, transport, chemical, pharmaceutical, IT, property and financial sectors, including on projects of strategic importance to the economy.

We support and represent our clients in:

  • proceedings before the European Commission, the Office of Competition and Consumer Protection (UOKiK), fund managing authorities and the ordinary courts
  • the process of obtaining and accounting for state aid – from eligibility analysis, through the preparation of application documentation, to day-to-day support and reporting
  • disputes concerning the repayment of state aid or its classification as unlawful
  • analysing the possibilities for accessing support from European and national funds
  • comprehensive support in preparing and carrying out the process of notifying individual aid and aid schemes to the European Commission
  • comprehensive support in situations where the support granted is challenged as state aid granted unlawfully or incompatible with the internal market, including representation in proceedings before the Commission
  • support in negotiating and managing grant agreements for funding from European and national sources, including monitoring the use of the funding and any potential need for its repayment
  • developing investment and financial strategies using available support instruments
  • analysing the possibilities for accessing aid for the restructuring and rescue of undertakings
  • support for entities entrusted with the provision of services of general economic interest and for entrepreneurs providing such services
