Public procurement
MJH’s Public Procurement Practice is comprised of a team of experienced lawyers who have been assisting clients with matters relating to public contracts for many years – representing both contractors and contracting authorities. Our advice covers all stages of the procurement process, from the preparation of documentation and tenders, through representation before the National Appeal Chamber (KIO) and the courts, to the administration of contracts concluded under public procurement law. Thanks to our practical knowledge of the market and the workings of public administration, we effectively help clients achieve their business objectives whilst minimising formal and regulatory risks.
We regularly support clients operating in the construction, IT, energy, pharmaceutical, transport and healthcare sectors. Our lawyers have been involved in numerous landmark and complex public procurement cases concerning, amongst other things, exclusion from procedures, rejection of tenders, undue performance bonds and contractual penalties.
We support and represent our clients:
- before the National Appeal Chamber and the ordinary courts – we develop litigation strategies, prepare appeals and complaints, and effectively defend our clients’ interests in disputes relating to tender procedures
- during the preparation of tenders – we analyse tender specifications, we assist in forming consortia and preparing full tender documentation
- in the performance of concluded contracts – we advise on contract amendments, settlements and disputes concerning proper performance of the contract
- in the area of compliance – we draw up internal procedures (including procurement regulations) and train staff in public procurement law, preparing companies for inspections and audits
